Performance product disclaimer

Dodson Motorsport Limited (“Dodson, “we,” or “us”) manufactures and distributes products solely for legally-organized and sanctioned, closed-course, off-road competition use. Dodson products are not intended for use on public streets, roads or highways. Installers and end users (the “Buyer” or “you”) install and use our products at their own risk. Do not use this product unless and until you have carefully read this disclaimer. Be sure to abide by all local, state and federal laws, including but not limited to emissions, vehicle safety, and traffic laws. It is your responsibility to know what those laws are and how they apply to you. The installation of any Dodson product on your vehicle indicates that you have (a) had the opportunity to inquire about applicable local, state and federal laws and (b) read and understand, and accept all of the terms of this disclaimer.


Warranty

Dodson warrants all products are free from manufacturing defects and worksmanship errors. Dodson takes responsibility for shipment of products free from damage to the location indicated on the Buyer’s order and will replace or refund items lost or damaged in shipment (except to the extent the Buyer’s actions, such as failure to pay for import duties, has caused the loss). Dodson makes no other warranty, express or implied.

The Buyer is to use Dodson’s catalog when ordering any product to ensure the requested product is the proper product for its intended application, and should enquire with Dodson sales and technical staff if further information on Dodson products are needed. The Buyer bears ultimate responsibility for compatibility of the purchased parts with their vehicle.

The Buyer has the final decision on parts usage and for assuming all risks, liabilities, and costs associated with use of Dodson parts. The Buyer acknowledges this disclaimer due to the unusual stresses placed on performance and high-end aftermarket vehicle parts. The Buyer acknowledges that Dodson has no control over the ultimate use of its products, which are frequently installed alongside other performance upgrading third party products.

Dodson must be notified of any defect as soon as it has been discovered and must be given access to the product in order to investigate any asserted defects, including but not limited to pictures of the part in question as well as any related parts, and/or return of the part to Dodson. Dodson may request supporting information such as vehicle history logs or information regarding other upgrades to the vehicle. The burden of establishing any asserted defect is on the Buyer, and any warranty replacements shall be provided at the sole discretion of Dodson. Dodson’s liability is strictly limited to repair or replacement of Dodson products, and any further compensation including labor, consumables, or damage to other components shall be at the sole discretion of Dodson, but is not express or implied. This warranty does not apply to any product which has been subjected to accident, negligence, or alteration by the Buyer, or that has been improperly installed. Warranty does not apply whatsoever in respect to accessories or parts not supplied by Dodson.

Dodson shall not be responsible for the Product’s proper installation, use, and service. Rather, the Buyer shall be solely responsible for the installation of the Product and any damage that may be done to vehicle components as a result of modifications made by the Buyer.

It is the Buyer’s responsibility to comply with all laws and regulations governing the resale of products. The purchaser agrees to hold Dodson harmless in this regard.

This limited warranty shall be governed by and construed in accordance with the laws of New Zealand. Any legal action which may arise as a result of disputes, controversies, and any claims arising out of, or related to this limited warranty, the purchase, or use of any product shall be litigated exclusively in the courts of New Zealand.

Dodson’s failure at any time to enforce this limited warranty shall not constitute a waiver of any provision.


RETURNS

The Buyer shall advise Dodson of any parts being returned within 30 days of receipt. Goods must be in the same condition as when dispatched. Damaged or contaminated goods will not be credited. Any return of goods correctly supplied by Dodson may be subject to a restocking fee of 20%. The Buyer is also responsible for the return freight and New Zealand import charges, if any.


PAYMENTS / PRICES

Payments are to be made in New Zealand Dollars unless otherwise agreed in advance. Prices may be subject to change due to currency fluctuation and other reasons prior to invoice or payment.


CANCELATION POLICY

Should the Buyer want to cancel an order, Dodson must be advised in writing prior to dispatch of the order. If the order has been dispatched during this time then the Buyer will need to take responsibility for the return of these items as per the returns policy. If funds for the order have already been collected, these may be subject to a processing fee upon return to the Buyer. Dodson reserves the right to limit cancellation of any order received in writing, particularly volume orders for which special stocking and manufacturing arrangements have been made.


TRADEMARK NOTICE

All names, images and logos identifying Dodson are proprietary marks of Dodson, including but not limited to Dodson Motorsport, Sportsman’s and Promax. Unauthorised use of any trademark displayed on this site is strictly prohibited.
